The Peoples Democratic Party brought its 27th witness, Barrister Mike Enahoro Ebah (PW27), before the Presidential Election Petitions Court in Abuja on Friday to establish that President Bola Tinubu faked his academic, employment, and diplomatic credentials.
Ebah, a private legal practitioner, presented INEC Forms EC13 and EC9 (nomination forms) submitted by Tinubu at INEC.
His nomination materials included an affidavit, receipts, and President Tinubu’s letter to INEC.
A.B. Mahmoud SAN, INEC’s lead lawyer, objected to the materials but promised to explain in his final presentation.
Tinubu, Kashim Shettima, and APC lawyers supported Mahmoud.
The PEPC concluded that the documents were admissible and labelled as exhibits.
After that, Enahoro presented Bola Tinubu’s academic records from Chicago State University, a subpoena served on the university by his lawyer in the US, a copy of his degree certificate, his undergraduate certificate from 1977, and a South West College Transcript identifying him as a female.
The witness also presented a notarized US District Court judgement about Tinubu’s purported confiscation of cash connected to his bank account and presumed to be profits of narcotic dealings, as well as a printed extract of the president’s Guinean passport.
The court allowed the materials after the respondents protested again.
Enahoro told INEC’s counsel, A.B. Mahmoud SAN, that he voted in Abuja on February 25.
Mahmoud questioned when he got the court paperwork, especially the first ones.
He stated his US lawyer sent the forwarding letter on November 1, 2022, and the US court ruling in April 2023.
Mahmoud questioned Enahoro why he didn’t protest about Tinubu’s INEC details.
The witness denied Mahmoud’s claim that he solely cared about Tinubu’s nomination.
Mahmoud asked, “Your candidate lost the presidential election as declared by INEC.
Enahoro acknowledged that INEC’s failure to declare Atiku Abubakar winner was disappointing.
Lawyers for Tinubu and APC postponed cross-examination today.
PDP lawyer Eyitayo Jegede SAN presented additional INEC-certified authentic copies of Form EC8As for Delta (25 LGAs), Ebonyi (13 LGAs), Edo (18 LGAs), Enugu (17 LGAs), Imo (27 LGAs), and Kogi states ( 21 LGAs).
The legal representatives of the Independent National Electoral Commission, President Bola Tinubu, Kashim Shettima, and All Progressives Congress challenged the acceptance of the papers. Still, they withheld their reasons until their final written address for judgement.
The court acknowledged the materials but ruled that objections would be decided with judgement.
