Top Nigerian lawyer breaks the beans on the Adamawa election crisis and reveals one key item INEC got right

Hudu Yunusa Ari, the resident electoral commissioner (REC) for Adamawa State, named Governor Ahmadu Umar Fintiri of the People’s Democratic Party (PDP) the victor of the supplementary vote without a figure on Sunday, April 16, making it the top story of the week.

Barrister Oluwole Olukunle Moses, a lawyer and political commentator, explained Ari’s action, the procedure that the Independent National Electoral Commission (INEC) quickly ruled “null, invalid, and of no consequence,” and how it damaged the nation’s democratic system.

A Nigerian lawyer praises INEC’s Adamawa poll answer, claiming it follows the Electoral Act of 2022.

“The announcement by the Resident Electoral Commissioner (REC) that Aishatu Dahiru, commonly known as Binani, won the Adamawa governorship election is a political smudge that has finally smuttered the leftover images of our nation’s democracy. So sad! The despicable statement by the REC, who usurped the power granted solely to the Returning Officer by Section 25 of the Election Act (amended in 2022) and virtually plunged the entire state into political inertness by pronouncing the election inconclusive, has deepened the breach in our nation’s democracy. I’m glad INEC quickly declared the REC’s decision null and unlawful under Section 65 of the Electoral Act.

“Let me clarify definitely that the announcement of Binani by the REC as the governorship election winner is a blatant breach of the Electoral Act and should be recorded as such regardless of the sentiments being whooped by some individuals in certain areas. No name-calling. The proclamation is unconstitutional, and INEC’s swift response is “ballon d’or.” No more.

According to the attorney, Dino Melaye might win Kogi.
Sen. Dino Melaye, a Peoples Democratic Party (PDP) contender for governor of Kogi State, drew the legal eminence’s attention in a different way.

Lawyer Moses stated of the PDP’s chances of beating the APC in Kodi State,

“With Dino Melaye’s nomination as the PDP gubernatorial candidate, a lot of comments have followed the selection process, which is not uncommon in Nigeria’s political cycle.”

“Having said this, Dino stands a possibility of winning the Kogi governorship considering the avalanches of complaints against the ruling party in the state. This does not imply he will sit on a golden platter, especially as the malignant vote-buying and manipulation sickness is still very prevalent in our election process, even with BVAS.

Who of the newly elected parliamentarians ought to be Speaker of the House and President of the Senate? Attorney Moses responds
The 2023 elections for the presidency and the national assembly, which gave the ruling All Progressives Congress (APC) a comfortable majority in both chambers of the national assembly, have demonstrated that a resounding majority of Nigerians have maintained their allegiance to the party in power.

With the party ready to lead the country into another phase of growth, zoning the Office of the Speaker of the House of Representatives of the 10th Legislature has become a prominent issue in politics.

Lawyer Moses claimed he wanted an Igbo to become the 10th assembly’s next speaker.

he Said :

“As the race for senate president in the tenth national assembly begins, notable political gavels like Ahmed Lawan (the incumbent Senate President), Orji Uzor Kalu, Adams Oshiomole, Godswill Akpabio, Barau Bibrin, Abdul-Aziz Yari, and others have started subtle campaigns and lobbying, and no doubt this is a race among the APC’s senators, being the party with the majority of seats. It is clear that the APC leadership would zone the office of Nigeria’s number three citizen, but that zoning choice is primarily influenced by political reasons, making it impossible to anticipate the 10th Assembly’s future leader.

“This is also my view of the House Speaker’s office. We can only hope for great leaders who aren’t puppets. But I personally want the Senate president office seat to belong to an Igbo to quell the ethnicity and religion spark fanned by the Muslim-Muslim government.”

On May 29, the Nigerian lawyer listed five crucial topics Tinubu’s administration should prioritise.

He advised the president-elect, Asiwaju Bola Ahmed Tinubu, to address the following major concerns for Nigeria’s growth and development:

Barrister Moses stated,

“Our electrical sector’s crisis must be addressed promptly.”

A fundamental constitutional reform of the judiciary is needed to make court orders enforceable. This is crucial because our country is already on a steep slope to lawlessness since nobody wants to respect court decisions again. Legal sanity in our country is at risk. Political office holders, government agencies, police, and the military—who should be implementing court orders—and even banks and private individuals defy them. Because law enforcement officers are under the executive’s sole control, the court cannot implement its own orders. This is bad for Nigeria. After being sworn in, the president-elect must address this constitutional threat.

Even if things are peaceful currently, he needs to solve the gasoline scarcity.

“Provide certainty for our precious naira.”

We don’t know if the old 200, 500, and 1000k will stick around. The CBN only opposes policy on existing and new naira notes. It’s hard to get the new 200, 500, and 1000 naira notes in the bank or anywhere else in Nigeria. It appears like all the printed new naira notes have vanished while the old ones are on the market. This is bad considering the huge cost of producing the new naira notes.

“To increase foreign profits, the new administration must take our economy seriously and invest in the local export industry.”

Adamawa poll: “The proclamation was unlawful and improper.” Mr. Williams Dakwom, a Plateau state APC presidential campaign committee (PCC) member, responded to the Adamawa state governorship election dispute.

The APC chieftain told Legit.ng on Sunday, April 23, that the state’s Resident Electoral Commissioner, Hudu Yunusa Ari, declared Senator Aishatu Dahiru (Binani) the APC’s governorship candidate in Adamawa, but INEC’s quick intervention was vital.

 he Said,

“The proclamation was unlawful, thus it was improper, and INEC’s rapid action was opportune.” “And she didn’t play a part of a democrat by adhering to her citizen’s mandate if honestly she’s a true democrat; not to push yourself on the people by any other methods.”

Tinubu comments on Adamawa, Kebbi, and other supplemental elections.
In another event, Nigeria’s president-elect, Asiwaju Bola Ahmed Tinubu, congratulated the victors of the weekend’s supplemental polls.

On Wednesday, April 19, Tinubu told Legit.ng this.

According to Tinubu, the election’s behaviour and mood showed that the people accepted the election’s conclusion.
