Threat of anarchy from Obi to Tinubu

The Labour Party’s presidential candidate in the February 25 election and first petitioner in the Presidential Election Petition Court (PEPC) case, Mr Peter Obi, has responded to the All Progressives Congress (second) ‘s and third respondents, President Bola Ahmed Tinubu and Kashim Shetimma, who argued that if the court interprets the Electoral Act, Section 134 against them, it could lead to anarchy.

In their last weekend statement before the court, President Tinubu’s legal team headed by Wole Olanipekun (SAN) warned that “any other interpretation different from theirs would lead to absurdity, disorder, anarchy and change of the basic objective of the legislature.”

Peter Obi’s attorneys, Dr Livy Uzoukwu (SAN) and Onyechi Ikpeazu (SAN), disagreed, arguing that anarchy rules when the rule of law is crushed or shortened.

Obi’s legal team stated: “A line in the 2nd-3rd respondents’ speech scared the petitioners and millions of Nigerians. ‘Our argument is that the petitioners are encouraging chaos by their venting of this problem of non-transmission of results electronically by INEC.'” The 2nd-3rd respondents fell too low and abandoned discretion.

“A cheap, stupid, and harmful blackmail aimed to damage the country’s judicial and constitutionalism,” they called Tinubu’s rant. It seeks to cannibalise our democracy.”

The legal team also noted that the second and third respondents’ careless and absurd statements intended to raise the issue of insecurity if the petitioners followed their bad example, but remarked that such would never happen due to the petitioners’ discipline, peaceful disposition, and belief in the rule of law.

The legal team asked, “When has it become objectionable for petitioners to canvass a basis provided for the challenge of an election under Section 134(1)(b) of the Election Act 2022?

They blamed the responses’ unnecessary flare-up and effusion on great desperation, which might be harmful.
